At 95 days I would certainly test the seller’s flexibility, but I wouldn’t assume the listing is automatically stale. The useful detail is whether it has genuinely been available for 95 continuous days, or was withdrawn, relisted or already had a price cut. Also, which neighbourhood boundaries...
The responsibility point can be made very practical. After acceptance, keep a simple list with each outstanding item, the person expected to act, what they are waiting for and the next follow-up date. “It is being handled” is not the same as knowing whether the file is waiting on the buyer...
